Contract Conditions
General Conditions
All orders are accepted subject to the terms of this rate card. American Way shall not be subject to liability for any failure to publish all or any part of any issue due to situations that are beyond its control. Publisher reserves the right to limit amount of advertising in any given issue. Publisher reserves the right to hold Advertiser and/or its advertising agency jointly and severally liable for such monies as are due and payable to the Publisher. Insertion orders are binding after closing date. No cancellations accepted after closing date.
Copy Acceptance
American Way reserves the unrestricted right to reject any advertising at any time after receipt of proofs. Advertisements simulating American Way's editorial matter in appearance or style are not acceptable. American Way reserves the right to require any advertising matter to be labeled "Advertisement" if the Publisher deems it necessary.
Rate Changes
Publisher may change rates at any time. Announcements of such changes will be made at least six weeks in advance of the first affected issue date.
Advertiser Responsibility
All advertisements are accepted by the Publisher on the assumption that the Advertiser and/or its agency is authorized to publish the entire contents of the advertisement. It is understood that the Advertiser and/or its agency will indemnify and render the Publisher harmless from any and all expenses arising from any claims based on the advertising content.
Advertising Position
Publisher will not be bound by any conditions, printed or otherwise, appearing on the Advertiser's order or copy instructions when such conditions conflict with the conditions set forth in this rate card.
Payments
Advertising invoices are issued twice each month and are due net 30 days from the date of invoice. Prompt payment will ensure uninterrupted advertising schedules.
Agency Discounts
Recognized AAAA agencies earn a 15% discount off gross rates. No cash discounts allowed. Agency discounts do not apply to mechanical services or special ink charges. Agency discounts not allowed on billings over 90 days past due.
